These Terms are the contract between you and us. We have written them so they are easy to understand.
Four things to know straight away:
1.1 SwipeOut (the "App") is provided by Vittorio Barile, Via Don Angelo Sanzò 37, 86017 Sepino (CB), Italy, VAT number 01826370700, email info@swipeout.it (the "Provider", "we", "us").
For support, notices and appeals, write to info@swipeout.it or use Settings → App and help in the App. This is the channel referred to throughout these Terms.
1.2 What it is for. SwipeOut helps you discover venues and events, send booking requests, leave reviews and organise nights out with groups.
1.3 What we do not do. We do not run venues, organise events, serve food or drinks, or sell tickets. When an event has a ticket office, we send you to the website that runs it: the purchase is between you and that website.
1.4 Where information comes from. Venue and event listings come from venues, from public sources and from third-party services. Some listings exist before the venue registers: in that case the information comes from external sources and may be less up to date. The listing says so.
2.1 When you register and accept these Terms, a contract for the supply of a digital service is formed between you and us.
2.2 What the contract includes. The contract includes:
2.3 Free, but with protections. To use SwipeOut you provide personal data. So even if you do not pay, you have the protections the Italian Consumer Code gives to people receiving digital content and services, including remedies if the service does not match what was promised.
2.4 You do not accept the privacy notice, you read it. It is information we owe you, not a contractual term. You can find it at https://swipeout.it/legal/consumer/privacy-policy/en.
2.5 Consents are something else. Personalisation, sponsored content based on your preferences, promotions by notification, location, gender, allergies, sharing preferences, attendance photos and signing reviews are separate, optional consents you can withdraw. Accepting these Terms does not count as any of those consents, and refusing them does not stop you using SwipeOut.
3.1 You must be 18. SwipeOut is only for adults. At registration you give your date of birth. If you are under 18, registration is refused. If we find out that an account belongs to a minor, we close it.
3.2 True information. The information you give us must be true and up to date. The phone number we ask for at your first booking must be yours: we verify it with a code sent by SMS.
3.3 One account per person, and you may not lend it. You are responsible for what happens with your credentials, unless someone else's use is not your fault. If you think someone has got into your account, change your password, log out of all devices from Settings → Account and write to us.
3.4 Username. Your username is created automatically from the part of your email address before the @. Other members of your groups can see it. You can change it, provided it is not offensive, does not impersonate someone else and does not contain contact details.
These rules are part of the Terms. They apply to everything you do on SwipeOut: profile, groups, proposal messages, reviews, photos.
4.1 Three basic rules.
a) Respect people. No insults, threats, harassment, or discriminatory, obscene, violent or unlawful content.
b) Only upload your own content, for which you hold the necessary rights.
c) Do not deceive. Do not pretend to be someone else, invent attendance, or review venues you have not been to.
4.2 You may not:
a) register with false details or someone else's details, or create more than one account, including to get around a suspension;
b) upload false attendance proof, taken somewhere you have not been or reused;
c) upload photos in which people can be recognised;
d) include other people's personal data, contact details, links or promo codes in messages, reviews or group names;
e) include health information about yourself or others in reviews;
f) use SwipeOut to advertise or sell without our permission;
g) report content out of spite, knowing it breaks no rule;
h) systematically extract data or content, including with automated tools;
i) decompile or reverse engineer the App, except to the extent the law does not allow this to be prohibited;
j) access systems, data or restricted areas without authorisation, or compromise the operation or security of the App.
4.3 Alcohol. On SwipeOut, no mission, level or reward is linked to drinking alcohol. The rules on serving alcohol are those of the venue and the law.
4.4 Consequences. If a rule is broken we act proportionately, as described in §§11 and 13: removal of content, suspension, and closure of the account only in serious or repeated cases.
5.1 You send a request, not a confirmed booking. A booking is confirmed only when the venue accepts it. If the venue does not reply within the time we show you when you send it, the request expires. For an important evening, it is worth calling the venue.
5.2 The contract is between you and the venue. We are not a party to it. We do not guarantee that the table is available, that the service is of a certain quality or that the venue keeps its promises.
5.3 No deposit on SwipeOut. You pay nothing to us to book. You pay the venue for what you consume, by its own methods.
5.4 When you see "Call" instead of "Book". If the venue is not accepting bookings through the App at that moment, or only has a landline, we suggest you call it.
5.5 Venues that are not registered. If the venue does not use SwipeOut but has a mobile number, we send your request by WhatsApp from SwipeOut's number. The message contains the data described in the privacy notice and, only if you have chosen to share them, allergies. The venue replies on WhatsApp and we show you the reply in the App. Once the message is sent, we cannot delete it from the venue's phone.
5.6 Cancelling and changing. You can cancel in the App up to the limit set by the venue, which we show you in the booking. Notes and allergies can be changed up to 2 hours before. After those limits, contact the venue. If the venue changes the time, you can cancel at any point.
5.7 If the venue cancels or leaves SwipeOut. We notify you in the App.
5.8 No-show. The venue can record that you did not turn up. You can see this in the booking. In this version of the App it has no effect on your account, except that you will not be invited to review that booking. If you think it is a mistake, write to us.
5.9 Allergies. If you choose to share allergies with the venue, SwipeOut passes on information and gives no guarantee. Sharing does not release the venue from its allergen obligations (Regulation (EU) 1169/2011) and does not replace talking to the staff.
If the allergy is serious, also say so in person or call the venue beforehand.
5.10 Guests. If you book for other people, you may give a guest's allergies only if that guest asked you to.
6.1 Who can review. You can review only if you booked through SwipeOut at a registered venue, after the booking has ended and only when invited. You can write at most one review per venue per month.
6.2 What a review contains. A review has a rating, up to three aspects and, if you like, a short text. For some aspects you can attach a supporting photo, which we check before accepting it.
6.3 Anonymous, unless you sign it. Reviews reach the venue in an anonymous monthly batch, and only if the batch includes enough different people. If you sign a review, the venue receives your name with it.
6.4 Moderation before sending. An automated check may remove parts of the text that are not allowed, such as personal data, contact details or health information. You see the result before confirming. If you disagree, you can ask for a review by a person (§11.4).
6.5 Reviews do not change the order of results. We do not use them to rank venues and events in the App and do not publish them as a score.
6.6 The venue's reply. The venue can reply to the batch and say what it has changed. It may not offer you benefits in exchange for a review or ask you, through SwipeOut, to come back.
6.7 Be honest. A review describes your experience. It is not written in exchange for benefits, about a venue you have not been to, or to harm a competitor.
7.1.1 Group types. A group can be closed (invitation only), private (invitation or an approved request) or open. Each type has a maximum number of members, shown in the App.
7.1.2 Captain and Vice-Captain. Whoever creates the group is its Captain and can appoint Vice-Captains. The Captain and Vice-Captains can invite, approve and remove members, and change the group's name, type and rules. A Vice-Captain cannot remove the Captain. Only the Captain appoints and removes Vice-Captains and can dissolve the group.
7.1.3 Entry rules. A group can require a minimum level or a mission achievement. The rule applies to everyone, including people who are invited.
7.1.4 There is no chat in groups. Members exchange only proposals of venues and events, each with an optional short message. Group names, messages and images are subject to the community rules and to moderation.
7.1.5 Proposals with the assistant. Each person can generate a limited number of proposals with the assistant each month, as shown in the App.
7.1.6 If the Captain leaves. If the Captain deletes their account, management passes to a Vice-Captain or, if there is none, to the member who joined first. A group left with only one person is dissolved.
7.1.7 Booking from a proposal. The person who made the proposal makes the booking. The venue receives neither the group name nor the list of participants.
7.2.1 To complete a mission step, you show you are at the venue or event with a photo, your location and the time. At venues, the step only counts during opening hours. You can complete at most one step a day.
7.2.2 Photograph the venue, not the people. A photo in which people can be recognised is not valid and is erased.
7.2.3 False proof. False proof breaches these Terms. It cancels the step and the points gained and, if repeated, leads to suspension of the account.
7.2.4 Review. Verification is automated. If you think a proof was rejected by mistake, write to us and a person will review it.
7.3.1 Verified attendance raises your level. Only you can see your level, points and achievements, and they can give you access to some groups.
7.3.2 They only count inside SwipeOut. Your level is not an assessment of you as a person, has no monetary value, cannot be converted into money and cannot be transferred.
7.3.3 We may change thresholds, achievements and benefits linked to levels. If a change puts you at a disadvantage, §14 applies.
8.1 How what you see is ordered. If you have given consent to personalised content, the order of the feed, map, calendar and assistant answers depends on:
The calendar is always in time order.
8.2 Non-personalised view. Without that consent you see content ordered by proximity, time and popularity. You can switch between the two in the settings, and the ordering never stops you finding a venue or event with search.
8.3 Sponsored content. All paid content carries the "Sponsored" label. Across the whole platform you receive at most one commercial communication a day. Whoever pays for a campaign chooses how many people to reach, not who, and does not receive your identity. The criteria by which a campaign reaches you are explained in the privacy notice.
8.4 The assistant. You ask a question, typed or spoken, and the assistant answers with venues and events taken from our catalogue. It is not a chat. Without a subscription you have a free allowance of questions, shown in the App and renewed every week. A question counts only when you receive an answer.
8.5 Artificial intelligence can make mistakes. Answers, proposals and automated moderation can be inaccurate. Check important information, such as opening times, prices and availability, directly with the venue.
8.6 Third-party information. Weather forecasts, maps and other information from third-party services are indicative.
9.1 What you get. The subscription increases the number of questions you can ask the assistant. Everything else on SwipeOut remains free without a subscription. Allowances, duration and any trial period are shown in the App before purchase.
9.2 Price. The price is the one we show you before purchase, including VAT, for a monthly or annual period.
9.3 Where you buy it. You can subscribe:
9.4 Automatic renewal. The subscription renews automatically when it expires, for a period of the same length and at the same price, until you cancel. If there is a trial period, the paid subscription starts when the trial ends, unless you cancel before. We remind you of this when you activate it.
9.5 How to cancel. You can cancel at any time, where you bought it:
Cancelling stops the next renewal. The subscription stays active until the end of the period already paid for.
9.6 Right of withdrawal. You have 14 days from purchase to withdraw without giving a reason. If at purchase you ask us to activate the subscription straight away, and you start using it within those 14 days, when you withdraw we refund the price minus the part corresponding to the period in which you used it. If you bought on the web, write to info@swipeout.it. If you bought through a store, request a refund through the store's procedure or write to us and we will help.
9.7 Price changes. If we change the price, we tell you at least 30 days before the renewal from which the new price applies. You can cancel before it takes effect. If you buy through a store, the store may ask you to confirm the new price.
9.8 If you delete your account. Deleting your account does not cancel a subscription bought through the App Store or Google Play: you must cancel it on the store yourself. A subscription bought on the web is cancelled automatically. If you delete your account during a period already paid for, we do not refund the unused part, except under the right of withdrawal in §9.6 and in cases provided for by law.
9.9 If the service gets worse. If we significantly reduce what the subscription includes, §14.4 applies and we refund the part of the price already paid for the period you will not be able to use.
10.1 Venue content belongs to venues. Menus, prices, allergens shown on menus, photos, opening times and events are published by venues under their own responsibility. We do not check them and do not guarantee they are accurate.
10.2 The menu allergen filter is an aid, not a guarantee. It shows only what the venue has declared. Dishes for which the venue has declared nothing are not hidden.
10.3 Your content stays yours. Profile photos, group images, messages, reviews and supporting photos remain yours. You grant us a free, non-exclusive licence limited to running SwipeOut, to:
The licence ends when you remove the content or delete your account. Reviews already delivered anonymously remain with the venue.
10.4 You confirm you hold the rights to the content you upload.
10.5 SwipeOut is ours. The software, name, logo, interface, databases and recommender systems belong to us or our licensors. We grant you a personal, non-exclusive, non-transferable licence to use the App for personal, non-commercial purposes for the duration of the contract.
10.6 Infringements of copyright, trade marks or other rights: report them to info@swipeout.it.
11.1 How to report. You can report any content from the App or by writing to info@swipeout.it, which is our point of contact for notices of illegal content. Your identity is never disclosed to the venue or to the user reported.
11.2 What we do. We examine the notice with care. If the content is illegal or breaches these Terms, we remove it or limit its visibility, and tell you the outcome.
11.3 We tell you why. If we remove your content, restrict a feature or suspend your account, we tell you:
11.4 You can appeal. Write to info@swipeout.it within six months of the decision. A person reviews the decision, even if it was automated, and replies within 14 days. You can still go to an out-of-court dispute resolution body or to court.
11.5 Automated moderation. Texts and images go through automated checks. These checks are imperfect: they can block legitimate content or let other content through. That is why §11.4 exists.
12.1 We provide the service with the professional diligence that can reasonably be expected, and in line with what is described in these Terms and in the App.
12.2 We cannot guarantee that the App will always be available and error-free, or that suggestions will match exactly what you were looking for. Maintenance, updates and problems with our providers can temporarily interrupt the service.
12.3 Venue and event information. Opening times, prices, availability, menus and programmes come from venues or third-party sources. Check them with the venue before you go.
12.4 Bookings, food safety, dealings with venues. §§5 and 10 apply: we are not responsible for the outcome of a booking, for what the venue does with allergy information, or for the quality of what the venue provides.
12.5 If the service is not in conformity. You are entitled to the remedies of the Italian Consumer Code: first, bringing the service into conformity and, where provided, a price reduction or termination of the contract.
12.6 What we never exclude. Nothing in these Terms excludes or limits our liability for wilful misconduct or gross negligence, for personal injury, or where the law, including consumer protection law, does not allow it to be limited.
13.1 We act proportionately. First we remove content, then we restrict or suspend the account, and only as a last step we close it.
13.2 We may suspend your account, for a proportionate period stated in our message, if:
We warn you first, unless the seriousness or urgency of the situation prevents it.
13.3 We may close your account only for serious or repeated breaches, or if the account belongs to a minor.
13.4 In every case we tell you the reason, and you can appeal as described in §11.4.
13.5 Inactive accounts. We do not close an account just because you do not use it.
13.6 If we close your account for a breach while you have an active subscription, we do not refund the remaining period, unless the closure turns out to be unjustified.
14.1 We may change these Terms to reflect changes in the law, the development of features, or technical and security needs.
14.2 Minor changes. Formal corrections, clarifications and updated references apply from publication, with the new date at the top of the document.
14.3 Significant changes. We notify you of changes affecting your rights and obligations with at least 30 days' notice, in the App or by email. The first time you log in after they take effect, we ask you to expressly accept them, with a short summary of changes. If you do not accept them, you can delete your account at no cost. If you have a subscription, we refund the part of the price for the unused period.
14.4 Changes to the service. If we change a feature in a way that puts you at a non-negligible disadvantage, we tell you with the same notice period and explain what changes. You can withdraw at no cost within 30 days of our message or of the change, whichever is later.
15.1 You can end the contract at any time, without notice, at no cost and without giving a reason, by deleting your account.
15.2 How. In the App: Settings, at the bottom of the page, Delete account. On the web: https://swipeout.it/legal/consumer/account-deletion/en.
15.3 Deletion is final and happens on confirmation. Future bookings are cancelled, except those starting within the next two hours, for which you must contact the venue. You leave your groups and your level is erased. To come back you will need to register again. What happens to your data is explained in the privacy notice.
15.4 For the subscription, §§9.6 and 9.8 apply.
16.1 Italian law applies. If you are a consumer living in another EU country, the mandatory rules of that country that give you greater protection still apply.
16.2 Jurisdiction. If you are a consumer, the court of the place where you live or have your chosen domicile has jurisdiction.
16.3 Out-of-court resolution. Before going to court, you can write to info@swipeout.it and we will try to solve the problem. You can also contact an alternative dispute resolution (ADR) body under the Italian Consumer Code.
16.4 Complaints about personal data: Italian Data Protection Authority, www.gpdp.it.
17.1 If a clause is found to be invalid, the others remain valid.
17.2 If we do not enforce a right straight away, it does not mean we waive it.
17.3 Assignment. You may not transfer the contract to anyone else. We may transfer it to a company that continues the SwipeOut business, without reducing your protections. In that case we give you 30 days' notice and you can withdraw at no cost.
17.4 Language. These Terms are available in Italian and English, and both versions are equally valid. If there is doubt about interpretation, the one most favourable to you prevails.
